Terms of Service

By accessing or using OwnRanks ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all users, including business owners, their employees, and end customers who submit feedback through the Platform.

We may update these Terms at any time. Continued use after changes means you accept the updated Terms.

To use OwnRanks as a business, you must create an account. You agree to:

• Provide accurate, current, and complete business information
• Keep your login credentials secure and confidential
• Not share your account with anyone else
• Not create multiple accounts to bypass trial limits or discounts

You are responsible for all activity under your account. Notify us immediately at hello@ownranks.com if you suspect unauthorized access.

We reserve the right to refuse service, suspend, or terminate accounts that violate these Terms.

OwnRanks offers subscription plans (Starter, Growth, Business) on a monthly or annual basis.

• Free trial:
• Every plan includes a 14-day free trial. No credit card required.
• If you don't cancel before the trial ends, your plan converts to a paid subscription automatically.

• Payments:
• All payments are processed securely via Razorpay.
• You authorize us to charge your chosen payment method at the start of each billing cycle.
• Prices are displayed in your local currency and may include country-specific discounts.
• Early-access discount codes must be applied at checkout and cannot be combined with other offers.

• Taxes:
• You are responsible for any applicable taxes, GST, VAT, or other government charges.

Our Refund Policy is available at /refund-policy and is incorporated into these Terms.

You may use OwnRanks to collect feedback from your customers, generate QR codes, manage reviews, and access analytics.

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of any local, state, or national laws
• Collect feedback through deceptive or coercive means
• Submit fake, fraudulent, or misleading feedback
• Attempt to manipulate ratings, reviews, or analytics
• Use scrapers, bots, or automated tools to extract data without our written permission
• Interfere with the Platform's security, servers, or infrastructure
• Upload malicious code, viruses, or anything that could harm the Platform
• Use the Platform to send spam or unsolicited messages

End customers who submit feedback are also bound by these Terms. Feedback must be honest and respectful.

As a business owner, you collect feedback from your customers through OwnRanks. Here's how this works:

• Ownership:
• You own the feedback data submitted by your customers.
• You are responsible for ensuring you have the right to collect and use this data (e.g., through a privacy notice at your business).

• Our role:
• We store, process, and display feedback data on your behalf.
• We use aggregated, anonymized data to improve the Platform.

• Customer privacy:
• End customers' personal data (email, name) is collected only if you choose to enable those fields.
• We do not sell end-customer data to third parties.
• You must comply with applicable data protection laws (e.g., India's Digital Personal Data Protection Act, GDPR if applicable).

• Review redirect:
• The Platform may offer customers the option to be redirected to your Google Maps listing to leave a public review. This is a feature you control and can disable anytime.

• Our IP:
• OwnRanks, the OwnRanks logo, and all platform code, design, and content are owned by OwnRanks or its licensors.
• You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written consent.

• Your IP:
• You retain all rights to your business name, logo, and other content you upload.
• By uploading content, you grant us a non-exclusive license to display and process it solely for operating the Platform.

• License to use QR codes:
• QR codes generated through OwnRanks may be used freely for your business. However, the QR code generation technology and the Platform remain our intellectual property.

OwnRanks integrates with third-party services including:

• Razorpay – payment processing
• Google Maps / Google Reviews – review redirect and location data
• Brevo (Sendinblue) – email delivery
• MongoDB Atlas – database hosting

We are not responsible for the uptime, security, or policies of these third-party services. Your use of these services is subject to their respective terms.

Google Maps/Reviews: By using the Google review redirect feature, you agree to comply with Google's Terms of Service and Google's Review Policy. Manipulating reviews or incentivizing only positive reviews may violate Google's policies.

• By you:
• You may cancel your subscription at any time by emailing hello@ownranks.com with subject "Cancellation Request".
• Upon cancellation, your access to paid features continues until the end of the current billing period.
• After that, your account is downgraded. Your feedback data is retained for 90 days, after which it may be deleted.

• By us:
• We may suspend or terminate your account if you violate these Terms.
• We will notify you via email before termination where possible.
• In case of termination for violation, no refund will be issued.

Data export: You can request a data export at any time by emailing us.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

• We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.
• We are not responsible for the accuracy of feedback submitted by end customers.
• We are not liable for any loss of business, revenue, or reputation resulting from your use of the Platform.
• We are not responsible for Google's review policies, algorithm changes, or review removals.

Limitation of liability: To the maximum extent permitted by law, OwnRanks's total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

No liability for third-party content: We are not responsible for content submitted by end customers through your feedback forms.

You agree to indemnify and hold OwnRanks harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms
• Any feedback or content you collect or submit through the Platform
• Your violation of any third-party rights, including privacy or intellectual property rights

These Terms are governed by the laws of India.

Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

For users outside India: You agree that Indian law governs these Terms, and any disputes will be resolved in Indian courts.
